How Mediation Works
1. START THE CONVERSATION
The mediator outlines the process, sets expectations, and helps clarify the issues that need to be addressed.
2. TELL YOUR SIDE
Each party is given the opportunity to express their perspective, concerns, and priorities in a supportive setting.
3. GET TO WORK
Discussions may occur together or in separate sessions known as caucuses. The mediator facilitates communication, explores options, and maintains momentum in negotiations.
4. DECIDE WHAT WORKS
If the parties arrive at an agreement, the terms can be documented as necessary. If an agreement is not reached, the parties retain their right to pursue the applicable legal process.
